End User License Agreement

This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("End User" or "you") and DailyGoal ("we," "us," or "our") for the use of the DailyGoal mobile application (the "App"), available through the Apple App Store.

This Agreement is between you and DailyGoal only, and not with Apple Inc. ("Apple"). DailyGoal, not Apple, is solely responsible for the App and its content.

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not download or use the App.

License Grant

Subject to your compliance with this Agreement, DailyGoal grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Subscriptions and In-App Purchases

DailyGoal offers both free and Pro tiers:

• Free tier — includes core tracking features such as food logging, workout logging, and basic goal setting.
• Pro tier — unlocks additional features including advanced analytics, personalized nutrition plans, and other Pro functionality. Available via auto-renewable subscription through the Apple App Store.

Regarding subscriptions:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
• Subscription prices may change from time to time. You will be notified of any price changes in advance and must agree to the new price to continue your subscription.

User Responsibilities

When using the App, you agree to:

• Provide accurate information when creating your account and entering health and fitness data.
• Maintain the security and confidentiality of your account credentials.
• Use the App only for its intended purpose of personal health and fitness tracking.
• Not attempt to reverse engineer, decompile, or disassemble the App.
• Not use the App in any manner that could damage, disable, or impair the service.
• Comply with all applicable laws and regulations in your use of the App.

Health Disclaimer

DailyGoal is a fitness and nutrition tracking tool and does NOT provide medical advice, diagnosis, or treatment.

The information provided by the App, including calorie calculations, macronutrient recommendations, TDEE estimates, and fitness tracking data, is for informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, diet, or exercise program. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked in this App. If you have or suspect a medical emergency, contact your doctor or emergency services immediately.

Intellectual Property

The App, including all content, features, functionality, design, text, graphics, logos, and software, is owned by DailyGoal and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any portion of the App without our prior written consent.

Maintenance and Support

DailyGoal is solely responsible for providing any maintenance and support services with respect to the App, as specified in this Agreement or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty Disclaimer

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, DailyGoal disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be DailyGoal's sole responsibility.

Product Claims

DailyGoal, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such intellectual property infringement claim. DailyGoal shall be solely responsible for handling such claims.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall DailyGoal be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; or (c) unauthorized access, use, or alteration of your data.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach this Agreement.

Upon termination, your right to use the App will cease immediately. You may also terminate this Agreement by deleting the App and your account. All provisions of this Agreement that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to This Agreement

We reserve the right to modify this Agreement at any time. If we make material changes, we will notify you by posting the updated Agreement within the App or by other appropriate means. Your continued use of the App after the effective date of the revised Agreement constitutes your acceptance of the changes.
